The North Carolina Brownfields Property Reuse Act has been revised to expand eligibility for the North Carolina Brownfields Program. Contamination caused by Underground Storage Tank releases was previously excluded from the Brownfield Program, but the statutory revisions now allow UST-contaminated sites to be eligible for redevelopment under the Brownfields Program.
"There are more than 5,000 UST sites across the state, particularly on land that houses old service stations, mills and other industrial properties that often used USTs for heating oil," says Alexander Elkan, a partner with Brooks Pierce who focuses on environmental and natural resources law.
