David Smyth quoted in Business Insurance on Whistleblower Protections
Brooks Pierce partner David Smyth was recently quoted in Crain Communications' Business Insurance. The article discusses whether or not the U.S. Supreme Court will have to review existing corporate whistleblower protections after lower courts have issued split rulings. David is one of several attorneys who weigh in on the opinions of the appellate courts and the likelihood that the Supreme Court will take the issue on. He says the ruling by the 5th U.S. Circuit Court of Appeals that a whistleblower who has only reported the issues internally does not qualify for protection is the clearer of the different rulings.
