Brooks Pierce attorney Darrell Fruth spoke to the Triangle Business Journal regarding the recent decision in patent litigation involving Cree and Feit Electric. The court ruled that Cree would have 10 days to amend its response to Feit's lawsuit in order to add two additional counterclaims that Feit had infringed on two of Cree's patents.
Fruth commented: "Companies use patents as swords and shields in high tech battles. In this case, Feit initially attacked Cree by alleging patent infringement, and then Cree responded, and said 'No, your patents are invalid.'"
