Bryan Starrett, an attorney in the Greensboro office, was recently interviewed by the Triad Business Journal on the impact of the Nov. 22 injunction of new rules from the Department of Labor governing overtime pay. The rules were scheduled to take effect on Dec. 1.
Starrett said he had been working with clients for several months to ensure they were in compliance with the implementation of the new rules, which were expected to extend overtime pay to millions of people. He said he knew that many companies were still not fully ready to incorporate the rules and, as a result of this ruling, those companies will have additional time to watch the ultimate outcome of the case and assess their compliance obligations and options.
The matter could eventually make its way to the U.S. Supreme Court, Starrett said, although there would be several legal steps and likely court hearings first. It’s also possible Congress could pass legislation on the matter.
