Brooks Pierce Attorneys Publish 2024 Prescribed Fire Liability Report for the Southern United States in Collaboration with UNC Law Pro Bono Students

Brooks Pierce attorneys Bill Cary and Jamey Lowdermilk published the Prescribed Fire Liability Report for the Southern United States: A Summary of Statutes & Cases 2024 update in collaboration with University of North Carolina (UNC) School of Law pro bono students earlier this year. The publication is updated annually.

The report fulfills the Southeast Regional Partnership for Planning and Sustainability’s (SERPPAS) Strategic Action Plan objective of providing a comprehensive strategy for increased prescribed burning in the Southeast region of the United States. The report explains various types of liability, summarizes prescribed fire laws and regulations for thirteen states, and highlights applicable court cases. Landowners, resource managers, and community members passionate about long-leaf pine restoration, climate change mitigation, and forest health value the annual update on the legal landscape.

Cary works with a variety of public and private entities in the emerging area of Climate Resilience planning and strategies. He also has extensive experience in employment law, counseling employers to avoid conflict and guiding them through difficult transitions, whether systemic or specific. His career has included extensive experience in litigation and mediation, especially in employment and environmental disputes.

Lowdermilk is an experienced and dynamic litigator and problem-solver. Her prelaw professional endeavors include public service at the local, state, and national level, as well as small business and nonprofit roles. She spent four years with the U.S. Forest Service as a resource specialist and firefighter (when needed). Her legal practice involves bankruptcy and restructuring, commercial and estate litigation, heirs’ property, land use, and nonprofit law. She is adept at big-picture thinking, be that companies, landscapes, or family trees. Whatever the vision or stressor, Jamey delights in finding a path forward for her clients.
