Brooks Pierce will sponsor a "lunch-and-learn" for the Research Triangle Area Chapter (RTAC) of the Association of Corporate Counsel (ACC) on Jan. 10 at City Club Raleigh. Partners Shana Fulton and Will Quick, along with FBI Cyber Squad Special Agent Jessica Nye and Berkeley Research Group Managing Director and Associate General Counsel Amy Worley, will give a continuing legal education presentation titled “Ethics and Other Lessons Learned ‘In the Breach’” to in-house counsel from organizations throughout North Carolina.
The panelists will cover best practices following the discovery of a possible data breach, including critical decision making at the outset of an investigation, preservation of the attorney-client privilege, avoidance of conflicts, presenting investigation results to a variety of audiences, and preparing for post-breach litigation. They will also discuss the ethical duties outside counsel owes to their clients when they experience a data breach.
Fulton represents businesses and individuals in criminal and civil litigation, under government investigation or in conducting internal investigations. As a defense attorney and former Assistant U.S. Attorney, she has experience litigating and investigating high-profile and complex matters at all levels of federal and state trial courts. She loves using her deep experience as a defense attorney and federal prosecutor on complex matters that feature a mix of criminal, civil and regulatory issues.
Quick has a diverse litigation and regulatory practice, representing businesses and local governments in trial and appellate matters and before state agencies in North and South Carolina. He also advises clients on the design and implementation of privacy compliance programs and assists data breach victims with their response and notification obligations. Quick is a Board Certified Specialist in Privacy and Information Security Law from the North Carolina Board of Legal Specialization.
