On Tuesday, December 3, 2024, a United States district court in the Eastern District of Texas issued a national preliminary injunction enjoining the enforcement of the Corporate Transparency Act.1 The injunction specifically enjoins the Government “from enforcing the Reporting Rule and the January 1, 2025 [ ] compliance deadline.”
This injunction stays the reporting deadline of January 1, 2025 that applies to reporting companies under the Corporate Transparency Act.
The United States Department of Justice may appeal the injunction. We will issue additional alerts as more information becomes available. The district court’s injunction should not be read as the final determination as to whether the Corporate Transparency Act is unconstitutional; rather, it speaks only to the issue of whether the Corporate Transparency Act may be enforced while the litigation continues.
