Diversity and Inclusion

Overview

We help businesses and non-profits resolve diversity and inclusion-related disputes. Through confidential assessments, we also help them actively practice their values by building and implementing robust diversity and inclusion policies, procedures, and programs that comply with recent changes in the law.

Disputes

Our attorneys are well-versed in all areas of business and nonprofit law, from advising on employer policies and procedures to complying with government regulations to litigating high-stakes, high-profile disputes.

We work to resolve issues quickly and fairly outside of court, but when necessary, our interdisciplinary team is ready to go to bat to ensure our clients are well-represented with thorough counsel and the strongest legal arguments.

Our attorneys have advised and litigated countless diversity and inclusion-related matters, including:

  • Advising non-profits, educational institutions, and alumni groups on the modification of diversity and inclusion-related programs and scholarships following recent judicial decisions.
  • Conducting internal investigations, particularly for clients managing pressure from regulators, whistleblowers, shareholders and civil litigants.
  • Assisting clients with development of lawful policies and practices designed to foster inclusive work environments
  • Counseling construction companies and contractors on government contracting, including bid development and minority and women-owned business enterprise (MWBE) programs.
  • Representing organizations and individuals in connection with the removal of Confederate monuments and public demonstrations.
  • Litigating various discrimination claims.

Assessments

We also work with organizations to assess their operations to help them meet their diversity and inclusion-related goals.  We provide strategic and practical advice and recommendations, mindful of the business, legal, stakeholder, and other challenges organizations face.

Our confidential assessments identify areas in which organizations can make tangible improvements to their policies, practices, and workplaces consistent with their own objectives. Our recommendations provide them the roadmaps to get there.

Areas in which we have provided assessments and recommendations include:

  • Policies and procedures
  • Hiring and recruiting
  • Board diversity
  • Mentoring and sponsorship
  • Crisis response
