- Securing Real Estate and Financing Our team can provide legal counsel on all steps of the real estate process including negotiating the purchase of land and overseeing the closing process. We can also advise on project financing and navigating the lending process.
- Front-End Contracting Our team represents and advises owners, lenders, developers, design professionals, construction managers, general contractors and subcontractors in drafting and negotiating contracts for all types of commercial and institutional projects. We understand that contract negotiation is principally about risk allocation and work to ensure our clients do not take on any unnecessary risks and are properly compensated for the risks they do take.
- Dispute Resolution Unfortunately, even with the best written contracts, sometimes things go awry. Brooks Pierce represents owners, contractors and subcontractors in disputes during all phases of a construction project, including negotiating change orders, filing or disputing liens and challenging or defending payment and performance bond claims and other claims that may arise during a project.
- Litigation While we first seek to resolve issues through negotiation and arbitration, going to court is frequently an option. When litigation is the best option, we fight on behalf of our clients’ interests in state and federal courts.
